Interpretation and Definitions

Words that start with a capital letter have specific meanings as outlined below. These definitions apply the same way whether they're singular or plural. Here's what we mean by the key terms in these Terms and Conditions: • Affiliate means an entity that controls, is controlled by or is under common control with a party. • Country refers to: Washington, United States • Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Northpilot. • Device means any device that can access the Service such as a computer, a cellphone or a digital tablet. • Service refers to the Website. • Terms and Conditions (also referred as "Terms") mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service. • Third-party Social Media Service means any services or content provided by a third-party that may be displayed, included or made available by the Service. • Website refers to Northpilot. • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Acknowledgment

These Terms and Conditions govern how you use this service and establish the agreement between you and us. They spell out what rights and responsibilities all users have when accessing the service. Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service. By accessing or using the service, you're agreeing to follow these terms. If any part of them doesn't work for you, you can't use the service. You also need to be at least 18 years old. We don't allow anyone under that age to use this service.

Termination

We can shut down your access right away, without warning, for pretty much any reason including if you break these terms. Once that happens, you lose the right to use the service immediately.

Limitation of Liability

No matter what damages happen, the most you can get from us or our suppliers under these terms is either what you've actually paid us through the service or a hundred bucks if you haven't bought anything. To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

"AS IS" and "AS AVAILABLE" Disclaimer

The service comes to you as-is and as-available, with all its flaws and problems, with no guarantees attached. We and our affiliates, licensors, and service providers disclaim all warranties—whether express, implied, statutory or whatever—about the service. That includes implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that might come from dealing with us, how we perform, usage or trade practice. We're not making any representation or warranty of any kind, express or implied: (i) about how the service operates or whether it's available, or about the information, content, materials or products on it; (ii) that the service will run without interruption or errors; (iii) about the accuracy, reliability, or currency of anything provided through the service; or (iv) that the service, our servers, the content, or emails from us are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.

Governing Law & Disputes Resolution

The laws of the Country, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws. If you have a problem with the service, we ask that you try to work it out with us first before taking it further.

Compliance & Regulations

For European Union (EU) Users: If You are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which You are resident. United States Legal Compliance: You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a "terrorist supporting" country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.

Severability and Waiver

If any part of these terms turns out to be unenforceable or invalid, we'll change or interpret it to make it work as much as possible under the law. The rest of the terms stay in effect. If we don't enforce a right or require you to do something under these terms, that doesn't mean we can't enforce it later. And if we let one thing slide, that's not a waiver for everything else.

Changes to These Terms and Conditions

These terms might be translated, but the original English version is what counts if there's a dispute. We can update or replace these terms whenever we want. If it's a big change, we'll give you at least a month's notice before it goes into effect. By continuing to use the service after the update, you're accepting the new terms. These terms are effective starting from the date at the top of this page.
